Terms of Service

In one paragraph

These Terms form a contract between you and Thrive Haven Ltd. They describe what we promise (verified-death message delivery as configured by you), what we do not promise (we are not a legal will, we are not a vault, we cannot guarantee delivery if you misconfigure the service), what you owe us (a subscription or one-off payment), what we owe you (operating the service in good faith, encrypting your content at rest, not selling your data), and what happens when one side does not meet its end.

1. Who you are contracting with

Thrive Haven Ltd, a company registered in England and Wales (company number 16319387), with its registered office at 22 Waltham Road, Newton Abbot, Devon TQ12 1LH, United Kingdom. In these Terms, "we", "us", and "If You Die" all mean Thrive Haven Ltd.

2. What you are agreeing to

By creating an account you agree to these Terms, our Privacy Policy, our Cookie Policy, and our Sunset Policy. If you do not agree, please do not use the service.

3. The service

If You Die offers four tiers, summarised at /pricing:

  • Free: one recipient, one letter, quarterly check-ins, trusted-contact attestation. No payment.
  • Personal: ten letters, ten recipients, monthly or quarterly check-ins, five trusted contacts. Subscription.
  • Family: a household with up to five accounts, each fully private from each other, weekly, monthly, or quarterly check-ins. Subscription, plus add-ons for extra seats.
  • Founder: a household with unlimited members, every feature ever shipped, paid once. No renewal.

At the core, the mechanic is the same on every tier:

  1. You write letters and nominate recipients.
  2. You nominate trusted contacts (witnesses).
  3. We periodically email you a check-in. You confirm you are around.
  4. If you stop responding for the configured grace period, we contact your witnesses and ask them whether something has happened.
  5. When two witnesses independently confirm, we deliver each letter to the recipient you named.

4. Your account

You must:

  • Be at least 16 years old.
  • Provide accurate information (especially the email address we will use to reach you).
  • Keep your password reasonably secret.
  • Tell us promptly if you suspect unauthorised access.
  • Comply with applicable law in your country of residence.

You are responsible for everything that happens through your account, except where the cause is a security failure on our side.

5. Payment, renewal, and cancellation

5.1 Subscriptions (Personal, Family)

  • You pay in advance, monthly or annually.
  • Renewals happen automatically until you cancel.
  • You can cancel at any time inside your account; cancellation takes effect at the end of the current period.
  • We do not pro-rate refunds for unused time on a cancelled subscription, except as required by UK consumer law (see 5.4).

5.2 Founder (one-time payment)

  • Founder is a single payment for the lifetime of the account.
  • "Lifetime" means: for as long as Thrive Haven Ltd operates the If You Die service. If we stop operating, our Sunset Policy describes what we will do to honour our promise.
  • Founder is sold in batches at incrementally higher prices. The price you paid is the price you paid; we will not retroactively charge you more.
  • If we materially reduce the Founder feature set, we will offer you a pro-rated refund.

5.3 Family seat add-ons

  • Extra Family seats are billed monthly on top of the base Family subscription. Adding or removing seats prorates automatically through Stripe.

5.4 Refunds and cooling-off

  • UK consumer law gives you a 14-day cooling-off period from your first paid checkout. If you change your mind in that window, email us and we will refund your most recent payment in full.
  • If we are at fault (e.g. extended outage, materially defective delivery), we will refund a fair amount on request.
  • If you cancel a Founder purchase within the 14-day cooling-off window, we refund the full amount.
  • Outside the cooling-off window, refunds are at our reasonable discretion.

5.5 Failed payments

  • If a renewal payment fails, we will retry and email you.
  • After 30 days of consecutive failure, your subscription pauses. Your data is retained on a Free tier (with the Free tier's limits).
  • For Family households, a 30-day past-due window triggers the takeover process described in our Sunset Policy.

5.6 Taxes

  • Prices on /pricing are shown inclusive of UK VAT where applicable.
  • If you are a business and provide a valid VAT identification, prices may be billed exclusive of VAT, subject to the place-of-supply rules.

6. The delivery promise (and its limits)

We promise to:

  • Operate the check-in cron at the cadence you set, plus or minus a few hours for batched delivery.
  • Encrypt the body of every letter at rest before it is stored.
  • Not deliver anything until at least two trusted contacts you nominated have independently confirmed.
  • Provide the recipients you named with a secure link to read each letter.
  • Log every state change in an immutable audit record.

We do not promise:

  • That email reaches every recipient. Deliverability is partly out of our hands. We will retry, alert you of bounces, and let you reconfigure.
  • That a recipient will open the link. We can show you whether they did, no more.
  • That an external service we depend on (Stripe, Firebase, SendGrid, Vercel) will not have downtime. We choose reputable providers, but we do not own their uptime.
  • That If You Die is a substitute for a legal will. It is not. Talk to a solicitor about your assets.

7. What you must not do

  • Use the service to harass, threaten, defame, or coerce another person.
  • Use it to plan harm to yourself or anyone else.
  • Upload material that infringes someone else's copyright or other rights.
  • Attempt to bypass the witness attestation mechanism or to forge a death.
  • Attempt to access another account, including via brute force or social engineering.
  • Resell or sublicense the service.
  • Use it for any unlawful purpose under UK law or the law of your country of residence.

If we reasonably believe you have done any of the above, we may suspend or terminate your account with notice. Severe breaches may be reported to the appropriate authority.

8. Intellectual property

You own your letters and the information you give us about recipients and witnesses. By using the service you grant us a limited licence to store, transmit, and (at the relevant moment) deliver this material. The licence terminates when you delete the account, subject to the retention windows in the Privacy Policy.

We own the If You Die brand, software, and design. You may not copy or reuse them outside normal customer use.

9. Liability

Nothing in these Terms limits:

  • Our liability for death or personal injury caused by our negligence.
  • Our liability for fraud or fraudulent misrepresentation.
  • Your rights as a consumer that cannot be limited by contract under UK law.

Subject to that, our total liability to you for any loss arising from your use of the service is capped at the greater of (a) the total amount you have paid us in the twelve months before the event that caused the loss, and (b) one hundred pounds sterling. We are not liable for indirect, consequential, or special losses.

We acknowledge that the consequences of a false-positive delivery (a letter sent while you are still alive) or a false-negative non-delivery (a letter not sent when it should have been) can be serious. The witness-attestation model, the multi-day grace period, the immutable audit log, and our internal procedures exist to reduce these risks to as close to zero as we can. Where we have failed despite reasonable care, we will work with you in good faith on a remedy that is in proportion to the harm.

10. Termination

  • You can close your account at any time inside the dashboard. Your data is wiped within 30 days.
  • We may terminate your account, with notice, if you breach these Terms, fail to pay, or use the service for a prohibited purpose.
  • If we discontinue the service entirely, our Sunset Policy applies.

11. Changes

We may revise these Terms. We will give you at least 30 days notice of any change that materially affects you, by email to the address on your account. If you do not agree to a change, you may close your account.

12. Governing law

These Terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these Terms is subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer-protection rules of your country of residence give you additional rights you cannot waive.

13. Model cancellation form

Under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you may exercise your 14-day right to cancel by completing and returning the form below. You can also email us in your own words; we will treat that as a valid cancellation as long as it reaches us within 14 days of your first payment.
